TERMS AND CONDITIONS

1. General
· These Terms and Conditions ("Terms") govern the provision of services by Annyse Makeup Artist registered as Annyse Applegate ABN 95 152 482 465 ("we", "us", "our") to the client ("you", "your"). By booking a service with Annyse Makeup Artist you agree to be bound by these terms. Please read them carefully.
· Terms are subject to change until a deposit has been received. Payment of your deposit acknowledges your agreement and acceptance of all terms. You will be bound by the terms listed at the time your non-refundable deposit has been paid.
· These Terms are governed by the laws of Queensland, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland. Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).
2. Bookings and Payments
· All booking requests are to be made through the event makeup or bridal makeup booking forms available at www.annyse.com.au. Submission of these forms is a booking request only.
· If your requested booking is available, you will be issued with a quote for the requested services. Quotes are valid at the time of issue only and are subject to change until a deposit is received. Your quote and requested booking may be cancelled and offered to other clients if it is either not accepted or the required payment is not made.
· A non-refundable and non-transferable deposit is required to secure your booking. Your booking is not confirmed until the deposit is received and a confirmation email is sent.
· The deposit amount will be deducted from the total invoice price. The remaining balance must be paid in full by the final payment date stated on your invoice.
· If the remaining balance is not paid by the final payment date, Annyse Makeup Artist reserves the right to cancel your booking and retain or invoice up to 50% of the total cost of the invoiced services to cover losses and administrative costs.
· Any additional services payable on the day must be paid via PayID or cash.
· Rates are secured once a non-refundable deposit is paid, except where a public holiday surcharge (10%) applies.
· All bookings requiring travel will incur additional travel fees, calculated based on your specific booking details.
· Late payments may incur an administrative fee or interest of up to 5% per week after the due date.
3. Booking Changes
· All booking changes must be communicated in writing via email as soon as possible.
· Booking changes may incur additional fees, including a $25 administration fee per amendment.
· Examples of changes that may incur fees include (but are not limited to) changes to the address, number of clients, start/finish times, parking or toll requirements.
· Any additional services not listed on your invoice cannot be guaranteed, but if accepted, full payment will be required upfront.
· Rescheduling is not always possible and is at our discretion. All rescheduling requests must be in writing and may incur administration and/or cancellation fees.
4. Cancellations/Refunds
· If Annyse Makeup Artist must cancel your booking due to circumstances not related to your breach of these Terms, you will receive a full refund of all monies paid for the affected date/time.
· Client cancellations must be made in writing to info@annyse.com.au.
· If you cancel your booking, the following applies:
o 8 weeks or more notice: Deposit forfeited.
o Less than 8 weeks notice: No refunds issued; you remain liable for the total booking cost if unpaid.
· No refunds are issued for reductions in the number of booked clients with less than 8 weeks’ notice or once the final payment has been made.
· In cases of serious illness, injury, or other compassionate circumstances (e.g. bereavement), we may, at our discretion, allow the deposit to be transferred to a future booking.
· We reserve the right to cancel bookings or refuse service while retaining all payments (or invoicing the full amount) if any unsafe, unhygienic, or distressing conditions arise, including where clients:
o Arrive more than 15 minutes late,
o Are under the influence of drugs or alcohol,
o Display aggressive or abusive behaviour,
o Fail to disclose relevant health conditions, or
o Do not provide a safe working environment.
5. Force Majeure (Weather and Unforeseen Events)
· We are not liable for failure to perform services due to circumstances beyond our control, including but not limited to extreme weather, natural disasters, pandemics, strikes, travel disruptions, or government restrictions.
· If a service must be cancelled due to such events, we will offer to reschedule where possible. If rescheduling is not possible, refunds will be at our discretion.
· Clients acknowledge that weather conditions may affect makeup results, and outcomes cannot be guaranteed under adverse conditions.
6. Minimum and Maximum Numbers
· A minimum of three (3) adults is required for all wedding bookings. If numbers reduce below this, the minimum charge still applies.
· A maximum of seven (7) adults per wedding booking applies, subject to timing requirements.
· Event bookings requiring travel may also have minimum number requirements depending on distance.
7. Makeup Trials
· Unless otherwise agreed, all trials are held at Annyse Makeup Artist’s home studio in Morayfield, QLD 4506.
· Trials are generally held on weekdays and are subject to availability.
· If you cancel your main booking after a trial, the trial fee and deposit for your main booking remains non-refundable.
8. Health, Safety and Wellbeing
· Clients must disclose all illnesses or health conditions prior to the booking, including contagious infections or other conditions that could affect service. This includes but is not limited to: pregnancy, contagious infections such as cold sores, conjunctivitis, lash mites, common colds and flus, vomiting, diarrhoea and viral or bacterial infection and is applicable for any clients receiving makeup services.
· Clients must also disclose allergies and sensitivities. If these cannot be safely accommodated, service may be refused to protect client safety.
· For bookings requiring travel, the following must be available: bathroom, toilet, water, power outlets, parking near the getting ready address, and a large hip-height table for tools/products.
· Clients must disclose if they or anyone receiving makeup services weighs over 120kg, as an alternative chair may be required for safety.
· Annyse Makeup Artist will determine whether services can/cannot be performed depending on the nature of the health information or booking conditions and reserves the right to refuse services based on this information. Annyse Makeup Artist will not be liable for any resulting reactions or issue.
9. Client responsibilities
· Punctuality: Clients must be ready to commence services at the agreed time. Late arrival may reduce application time and alter the final result.
· Makeup Preparation Requirements:
o Arrive with a clean, makeup-free face.
o Avoid applying products (e.g. serums, masks, sunscreen) that may interfere with makeup.
o For best results we strongly recommend that you exfoliate, cleanse and moisturise the night prior to your booking, and cleanse and moisturise the morning of your booking.
· Consultation: All clients are required to participate in a brief consultation before application to discuss their desired look, health information and any special requests. Please bring inspiration images (ideally including at least one from Annyse Makeup Artist’s previous work).
· Communication: Clients are encouraged to communicate openly and kindly regarding preferences or concerns.
· Aftercare: Follow any aftercare instructions provided to help maintain the integrity and longevity of the makeup including refraining from excessive touching, scratching and wiping.
10. Liability
· To the maximum extent permitted by law, Annyse Makeup Artist shall not be liable for any indirect, incidental, consequential, exemplary, punitive or special damages however characterised, including but not limited to allergic reactions, eczema, sensitive skin and eyes, breakouts or rashes.
· Our total liability for any claim shall not exceed the total amount paid for the specific booking.
· If you break this agreement, you will be responsible for any costs, losses, or damages that result. You will not hold the Artist (Annyse Applegate / Annyse Makeup Artist) responsible for those issues.
· Clients are responsible for any damage to our equipment during the booking caused by negligence or intentional acts and agree to reimburse repair or replacement costs.
· If legal action is required to enforce this agreement, the client agrees to cover reasonable legal or solicitor fees incurred by Annyse Makeup Artist.
11. Media and Photography
· We reserve the right to capture photos or videos during services for portfolio and promotional purposes across our social media, website, and marketing materials.
· Media will be captured respectfully and will not interfere with your experience or privacy.
· The Client accepts that all photographs and videos will be taken and edited at our discretion.
· Clients must notify us in writing if they do not consent to media use.
· No further payment or consent will be required for media use, and we retain full copyright ownership.
· For clients under 16 years of age, consent must be signed by a parent or legal guardian.
· We will, where possible, credit other suppliers (e.g. photographers, venues) and request reciprocal credit.
12. Personal Information
· We collect personal information such as name, contact details, event information, and relevant health details solely for booking, communication, and service delivery purposes.
· Personal data is stored securely and accessed only by Annyse Makeup Artist.
· We will not share personal data with third parties unless required by law or with your consent.
· You have the right to access or correct your personal information and to opt out of marketing communications.
